Terms of Service for Macher

These terms govern the use of the Macher app (the “App”), provided by Jannis Klaus.

1. What Macher is

Macher is a party game for events: you complete challenges, capture them as a photo or video “proof,” and share them with your crew or publicly within an event. The App is free and contains no advertising.

2. Minimum age

Use is permitted to people aged 16 and over. By setting up an account you confirm that you are at least 16 years old.

3. Account

Browsing is possible anonymously. To contribute (post proofs, comment, create challenges), signing in with “Sign in with Apple” is required. You are responsible for the activity under your account.

4. Code of conduct (House Rules)

When posting, you undertake not to publish content that

violates applicable law or the rules of the event,
contains nudity, sexually explicit depictions, glorification of violence, harassment, hate, or discrimination,
infringes the rights of third parties or trivializes dangerous acts.

If other people are identifiable in your proof, they must consent to it. Faked proofs are subject to the in-game “Tribunal” mechanic; unlawful or offensive content is subject to the reporting function.

5. Rights to your content

The rights to your content remain with you. You grant us a simple (non-exclusive), royalty-free license, limited in territory and time to the operation of the game, to store, display, and deliver your content within the App in accordance with the visibility you choose. This license ends when you delete a piece of content or your account; the content is then deleted server-side.

6. Shared content / watermark

When you share a proof from within the App, a watermark with the App’s logo and name is added. You are responsible for any further distribution outside the App.

7. Moderation, reports, and complaints (DSA)

We operate a hosting service within the meaning of the Digital Services Act (DSA).

Reporting: Every reported public item is reviewed. Unlawful content, or content that violates these terms, is usually removed within 24 hours; the responsible account may be suspended.
Blocking: You can block other users; their content then disappears from your App.
Statement of reasons: If content you posted is removed or your account is suspended, we inform you of the essential reason.

8. Termination and account deletion

You can irrevocably delete your account at any time via “Delete account” in Settings. We may suspend or delete accounts that repeatedly or seriously violate these terms.

9. Liability

You take part in challenges at your own risk and make your own decisions about carrying them out. Otherwise, we are not liable whatsoever.

10. Changes

We may amend these terms. We will notify you of material changes in an appropriate manner. The version published at the relevant time applies.

11. Final provisions

German law applies. Should any provision be invalid, the remainder of the contract remains effective. Mandatory consumer-protection provisions of the country of your habitual residence remain unaffected.
